By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

Eligibility

Our Services are available to customers of all ages. By using the Services, you represent that any information you provide is accurate and complete.

Products and Orders

All products displayed on our website are subject to availability. We reserve the right to limit quantities, discontinue products, or cancel orders at any time for any reason, including suspected fraud or errors in pricing or product information.

We may refuse or cancel an order if payment is declined, authorization fails, or inaccurate information is provided.

Customers may submit reviews or other content. By doing so, you grant Evisoles a non-exclusive, royalty-free right to use, display, and distribute that content.

We reserve the right to remove or moderate any reviews or content that we determine to be inappropriate, offensive, misleading, or otherwise unacceptable.

SMS / Mobile Messaging Terms

The Evisoles mobile message service (the “Service”) is operated by Evisoles LLC (“Evisoles,” “we,” or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time. Your continued use of the Service following the effective date of any such changes constitutes your acceptance of those changes.

By consenting to Evisoles’ SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Evisoles through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Promotional messages may include promotions, specials, updates, and other marketing communications (including cart reminders).

You understand that you do not have to enroll in this program in order to make a purchase, and your consent is not a condition of any purchase with Evisoles. Participation in this program is completely voluntary.

Evisoles does not charge for the Service; however, you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency may vary. Message and data rates may apply.

You may opt out of the Service at any time by texting STOP to +1 (844) 996-2507 or by clicking the unsubscribe link (where available). You will receive a one-time confirmation message after opting out. If you are subscribed to multiple Evisoles messaging programs, you must opt out of each program separately.

Wireless carriers are not liable for delayed or undelivered messages. You agree to provide a valid mobile number and to re-enroll if your number changes.

To the fullest extent permitted by law, Evisoles is not liable for failed, delayed, or misdirected messages, errors in message content, or actions taken in reliance on the Service.

Intellectual Property

All content on the Services—including logos, branding, designs, images, text, graphics, and website materials—is the exclusive property of Evisoles LLC and is protected by intellectual property laws.

You may not copy, reproduce, distribute, modify, or use any content without our prior written consent.

Fitness and Product Use Disclaimer

Evisoles products may be used for activities such as yoga, Pilates, and general wellness. Use of our products is at your own risk.

Evisoles is not responsible for injuries, accidents, or damages resulting from improper use, failure to follow instructions, or use during physical activity.

Limitation of Liability

To the fullest extent permitted by law, Evisoles LLC shall not be liable for any indirect, incidental, special, or consequential damages.

Our total liability shall not exceed the amount paid by you for the product giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Evisoles LLC from any claims, damages, or expenses arising from your use of the Services, violation of these Terms, or misuse of our products.
